1. Introduction

This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("User," "you," or "your") and ZedWed ("Company," "Platform," "App," "we," "our," or "us") governing your installation, access to, and use of our mobile applications, website, software interfaces, and related services (collectively, the "Services").

By installing the App, creating an account, accessing the Platform, or otherwise using the Services, you agree to be bound by this Agreement.

This EULA should be read together with our Terms of Service, Privacy Policy, Cookie Policy, Community Guidelines, Matchmaking Disclaimer Policy, Refund and Cancellation Policy, Data Retention and Deletion Policy, and any other applicable platform policies. Those documents work together and, except where this EULA specifically governs software-license use, the Terms of Service will generally govern service-use issues.

If you do not agree to this EULA, you must not install, access, or use the Services.

2. License Grant

Subject to your compliance with this EULA, the Terms of Service, and other applicable platform policies, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install, access, and use the Services solely for their intended lawful and personal, non-commercial purposes.

This license does not grant you any ownership interest in the Services or any underlying software, systems, content, data structures, workflows, or intellectual property.

3. Restrictions on Use

You must not, directly or indirectly:

  • copy, reproduce, distribute, modify, translate, adapt, sell, lease, rent, sublicense, assign, or commercially exploit the Services or any part of them except as expressly permitted by us in writing;
  • reverse engineer, decompile, disassemble, probe, or otherwise attempt to derive source code, underlying logic, models, data structures, or non-public functionality from the Services except where non-waivable law expressly permits such activity;
  • scrape, harvest, mine, extract, or collect user, platform, or system data without authorization;
  • use bots, scripts, automation, crawlers, or other unauthorized technical means to access or interact with the Services;
  • interfere with, disrupt, test, attack, bypass, or attempt to circumvent security controls, access restrictions, rate limits, integrity protections, or enforcement mechanisms;
  • share, sell, sublicense, or transfer your account or give another person access to use the Services through your credentials;
  • use the Services for unlawful, fraudulent, harmful, deceptive, or unauthorized purposes; or
  • use the Services in any way that violates our Terms of Service, Community Guidelines, or other applicable policies.

4. Ownership and Intellectual Property

All rights, title, and interest in and to the Services, including software, code, interfaces, trademarks, logos, databases, designs, workflows, layouts, documentation, and platform-generated materials, remain the property of ZedWed or its licensors.

Except for the limited license expressly granted in this EULA, no license or right is granted to you by implication, estoppel, or otherwise.

5. Your Obligations

You agree that you will:

  • provide accurate, current, and truthful information where required;
  • use the Services only if you are 18 years of age or older and legally permitted to do so;
  • keep your login credentials secure and maintain control of your device and account access;
  • accept responsibility for activity occurring through your account or device where attributable to your use, negligence, or failure to protect access;
  • comply with the Terms of Service, Community Guidelines, and other applicable platform policies; and
  • use the Services only for their intended legitimate purpose.

6. User Content and Platform Rights

You remain responsible for any content, information, messages, profile data, photos, verification submissions, questionnaire responses, or other materials you provide through the Services.

Your rights and our rights relating to user content are governed primarily by the Terms of Service and related platform policies. Nothing in this EULA transfers ownership of your content to us.

We may remove, restrict, disable access to, or preserve content where reasonably necessary to enforce our policies, comply with law, investigate abuse, address safety concerns, or protect the Platform and its users.

7. Automated Systems and Platform Features

The Services may include matchmaking, ranking, compatibility, recommendation, search, profiling, automated-analysis, or other AI-assisted features and outputs.

Such features are provided to support platform functionality and user experience. They do not create any guarantee of compatibility, accuracy, suitability, safety, user honesty, availability, or personal outcome.

Your use of any automated, recommendation-based, or AI-assisted output is at your own risk and remains subject to the Terms of Service and Matchmaking Disclaimer Policy.

8. Suspension and Termination

We may suspend, restrict, investigate, limit, disable, or terminate your access to the Services, with or without notice where permitted by law, if we reasonably believe that:

  • you have breached this EULA, the Terms of Service, or another applicable policy;
  • your conduct creates legal, fraud, safety, reputational, operational, or security risk;
  • your information is false, misleading, unverifiable, or associated with suspected abuse;
  • required verification, eligibility, compliance, or security checks fail or remain incomplete;
  • payment is reversed, disputed, unauthorized, or otherwise creates risk in connection with paid features; or
  • continued access would expose the Platform, its users, personnel, or third parties to harm or liability.

You may stop using the Services and request account deletion in accordance with the available product controls and applicable policies.

Termination or suspension does not automatically entitle you to a refund. Refunds, if any, are governed by the Refund and Cancellation Policy and applicable law.

9. Disclaimers

To the fullest extent permitted by law, the Services are provided on an as is, as available, and with all faults basis.

We disclaim, to the fullest extent permitted by law, all express or implied warranties, representations, and conditions, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, compatibility, availability, and uninterrupted or error-free operation.

Without limiting the above, we do not guarantee:

  • successful matches, relationships, engagement, marriage, or other personal outcomes;
  • the honesty, identity, intentions, availability, legality, or safety of any user;
  • that automated, recommendation-based, or AI-assisted outputs are complete, accurate, or appropriate;
  • that the Services will always be available on every device, operating system, territory, network, or platform channel; or
  • that defects, delays, or technical issues will be corrected within any specific timeframe.

Users interact with the Platform and with other users at their own risk, subject to applicable law.

10. Limitation of Liability

To the fullest extent permitted by law, ZedWed, its affiliates, directors, officers, employees, contractors, agents, licensors, and service providers shall not be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages, including loss of profits, loss of data, reputational harm, emotional distress, financial loss, loss of opportunity, device damage, or service interruption arising from or related to your use of or inability to use the Services.

Where permitted by law, our aggregate liability for claims arising out of or relating to the Services or this EULA shall not exceed the greater of:

  • the amount paid by you to us for the applicable paid service during the one (1) month immediately preceding the event giving rise to the claim; or
  • ZMW 0 where no such payment has been made.

Nothing in this EULA excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

11. Indemnity

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless ZedWed, its affiliates, directors, officers, employees, contractors, agents, licensors, and service providers from and against claims, demands, liabilities, damages, penalties, judgments, fines, losses, and reasonable legal or professional costs arising out of or related to:

  • your breach of this EULA, the Terms of Service, or another applicable policy;
  • your misuse of the Services;
  • your content, conduct, or interactions with users or third parties; or
  • your violation of applicable law or the rights of another person.

12. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy, Cookie Policy, and Data Retention and Deletion Policy. Our handling of personal data is subject to applicable law and the disclosures described in those policies.

13. Third-Party Services, Devices, and Availability

The Services may depend in whole or in part on third-party infrastructure, app stores, device environments, payment providers, hosting services, communication providers, network connectivity, browser compatibility, or operating-system support.

We do not guarantee that every feature or paid service will be available on every device, app version, territory, payment channel, or technical environment.

14. Dispute Resolution and Governing Law

This EULA and any dispute arising out of or relating to it shall be governed by the laws of Zambia.

The parties agree to first attempt to resolve disputes through good-faith direct engagement. If a dispute cannot be resolved informally, it may be referred to arbitration in Zambia in accordance with the Arbitration Act No. 19 of 2000, unless applicable law requires another route or preserves a non-waivable right.

To the extent permitted by law, disputes must be brought in an individual capacity and not as part of a class, collective, or representative proceeding.

15. Changes to This EULA

We may amend this EULA from time to time to reflect legal, technical, operational, security, business, or platform changes. Where appropriate, we may notify users of material changes through the app, website, email, or other reasonable means.

Continued use of the Services after changes take effect constitutes acknowledgment of the updated EULA, subject to applicable law.

16. Severability

If any provision of this EULA is found invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

17. Relationship to Other Policies

This EULA forms part of the broader contractual and policy framework governing the Services. It should be read together with the Terms of Service, Privacy Policy, Cookie Policy, Community Guidelines, Matchmaking Disclaimer Policy, Refund and Cancellation Policy, Data Retention and Deletion Policy, and other applicable platform policies.

If there is any inconsistency between this EULA and the Terms of Service on matters relating to general service use, enforcement, payments, or liability allocation, the Terms of Service will generally prevail unless this EULA expressly states otherwise or applicable law requires a different result.
